Terms of Service

This website is operated by Moral Compass. Throughout the site, the terms “we”, “us” and “our” refer to Moral Compass.

By visiting our website and/or purchasing from us, you agree to be bound by the following Terms of Service, including any additional terms, policies, and notices referenced on this site.

Please read these Terms carefully before using our website or placing an order.

1. Online Store Terms

By using this website, you confirm that you are at least the age of majority in your state, territory, or country of residence, or that you have given consent for a minor dependent to use this site.

You must not use our products, website, or services for any unlawful or unauthorised purpose.

You must not transmit any viruses, malicious code, or anything that may damage, disable, or interfere with the operation of our website.

A breach of these Terms may result in the termination of your access to our services.

2. Our Products

Moral Compass sells meaningful faith-inspired gifts, including jewellery and personalised keepsakes.

Some products may be made to order and may include personalised engraving or custom design elements. Because personalised items are created specifically for your order, please check all names, dates, spelling, wording, metal finish, and product selections carefully before checkout.

We aim to display product images, colours, sizing, and descriptions as accurately as possible. However, colours may vary slightly depending on your screen settings, lighting, and product photography.

3. Personalised & Engraved Orders

If you choose personalised engraving, you are responsible for ensuring all text is entered correctly at checkout.

Once production has started, we may not be able to change or cancel personalised orders.

We are not responsible for customer-entered errors including spelling mistakes, incorrect dates, incorrect names, or unwanted wording, unless the mistake was caused by us or our fulfilment partner.

If your personalised item arrives damaged, faulty, incorrect, or does not match the order details you provided, please contact us so we can review and resolve the issue in accordance with our Refund Policy and your rights under Australian Consumer Law.

4. Prices & Payment

All prices are displayed in the currency shown at checkout.

We reserve the right to change product prices at any time without notice.

Payment must be received in full before your order is processed.

We may use third-party payment providers to securely process payments. We do not store your full payment card details on our website.

5. Order Acceptance

After placing an order, you may receive an order confirmation email. This confirms we have received your order, but does not guarantee final acceptance.

We reserve the right to refuse, cancel, or limit any order where we believe there may be:

  • incorrect product or pricing information
  • suspected fraud or unauthorised payment activity
  • abusive or inappropriate engraving requests
  • shipping restrictions
  • supply or fulfilment issues
  • breach of these Terms

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item.

6. Shipping & Delivery

We aim to process and ship orders as quickly as possible. Delivery timeframes provided on our website are estimates only and may vary due to production time, carrier delays, public holidays, customs processing, incorrect shipping details, or circumstances outside our control.

You are responsible for providing a complete and accurate shipping address.

If an incorrect address is entered and the order has already shipped, we may not be able to redirect, replace, or refund the order.

Risk in the goods passes to you once the order has been delivered to the address provided at checkout.

7. Returns & Refunds

Returns and refunds are handled in accordance with our Return & Refund Policy.

Because many of our products are made to order or personalised, we do not generally accept change-of-mind returns for personalised or engraved items.

This does not affect your rights under Australian Consumer Law. Products must meet consumer guarantees, and if a product has a problem, customers may be entitled to a repair, replacement, refund, or other remedy depending on the circumstances.

8. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights you may have under Australian Consumer Law or any other applicable law.

Our goods come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

9. Product Care

Jewellery should be handled with care.

To help preserve your piece:

  • remove before bathing, swimming, or exercising
  • avoid perfume, lotions, chemicals, and abrasive materials
  • wipe gently with a soft cloth
  • store safely when not being worn

Damage caused by improper care, misuse, normal wear and tear, or accidental damage may not be eligible for replacement or refund unless required by law.

10. Accuracy of Information

We aim to ensure that information on our website is accurate and up to date. However, we do not guarantee that all product descriptions, pricing, images, availability, shipping details, or other content will always be error-free.

We reserve the right to correct errors, update information, or cancel orders if any information on the website is inaccurate, including after an order has been submitted.

11. Promotions & Discounts

Promotional offers, discount codes, and sales may be changed, paused, or withdrawn at any time.

Discount codes must be used before checkout is completed and cannot usually be applied retrospectively after an order has been placed.

Only one discount code may be used per order unless otherwise stated.

12. Intellectual Property

All content on this website, including text, images, graphics, product names, designs, branding, logos, and layout, is owned by or licensed to Moral Compass.

You must not copy, reproduce, distribute, modify, or use any content from this website without our prior written permission.

13. User Comments, Reviews & Submissions

If you submit reviews, comments, photos, messages, or other content to us, you grant us permission to use, reproduce, edit, publish, and display that content for marketing, website, and promotional purposes, unless you tell us otherwise in writing.

You must not submit content that is unlawful, offensive, misleading, defamatory, abusive, or infringes the rights of another person.

We may remove or refuse to publish content at our discretion.

14. Third-Party Services & Links

Our website may use third-party services, including payment processors, shipping providers, fulfilment partners, analytics tools, and marketing platforms.

We are not responsible for third-party websites, services, policies, or content. Your use of third-party services may be subject to their own terms and privacy policies.

15. Privacy

Your personal information is handled in accordance with our Privacy Policy.

By using our website and placing an order, you agree that we may collect, use, and share your information as needed to process your order, provide customer support, deliver products, prevent fraud, and operate our business.

16. Limitation of Liability

To the maximum extent permitted by law, Moral Compass will not be liable for indirect, incidental, special, or consequential loss arising from your use of our website, products, or services.

Nothing in this clause limits any rights or remedies you may have under Australian Consumer Law or any other applicable law.

17. Indemnity

You agree to indemnify and hold Moral Compass harmless from any claim, demand, loss, liability, or expense arising from your breach of these Terms, your misuse of our website, or your violation of any law or third-party rights.

18. Changes to These Terms

We may update these Terms of Service from time to time.

The latest version will always be available on this page. Your continued use of our website after changes are posted means you accept the updated Terms.

19. Governing Law

These Terms are governed by the laws of South Australia, Australia, unless another jurisdiction is required by applicable consumer law.
